‘Abused’ Boy, 9, Locked Away in Bedroom’ with Pneumonia Died When Lung Collapsed From Buildup of Pus: DA

A Detroit couple, both licensed foster care workers, are facing charges of felony murder, torture, and involuntary manslaughter in the tragic death of their 9-year-old ward, Owen, who prosecutors say was subjected to prolonged abuse and medical neglect.

According to the Wayne County District Attorney’s Office, Sherman Devaughn Jones, 46, and Sampaguita L. Jones, 41, were indicted last week, months after Owen died in September 2024 from pneumonia that was allegedly left untreated for weeks.

In a chilling court statement, Erin Wilmoth, lead prosecutor on the case, told Judge William Burton that Owen’s death was not sudden — it was a slow, painful deterioration caused by gross neglect and systemic abuse.

“This child suffered,” Wilmoth said. “And he suffered for a long time.”

An autopsy revealed Owen’s right lung had collapsed under the weight of a chest cavity filled with pus, a direct result of the untreated infection. But the horror didn’t end there.

Wilmoth detailed disturbing findings from the coroner: scars, bruises, scratches, and discoloration covered Owen’s body from head to toe. The damage was so extensive that the medical examiner declined to count the number of visible scars.

The boy was reportedly emaciated, underweight with a severely protruding stomach, and had sustained multiple healing and acute fractures, including to his ribs, pelvis, elbow, scapula, arms, and hands — evidence prosecutors say points to long-term, repeated physical abuse.

“The list goes on,” Wilmoth told the court grimly.

Adding to the alleged horror, the prosecution claimed Owen was isolated from the outside world, kept hidden indoors, and often locked in his bedroom to conceal the visible signs of abuse. Being homeschooled, Owen had no access to teachers, nurses, or regular wellness checks that might have exposed the abuse sooner.

According to Wilmoth, Child Protective Services (CPS) was alerted to concerns in June 2023, when a relative reported fears for Owen’s safety. However, CPS reportedly declined to open an investigation, a decision that may now come under intense scrutiny.

The prosecution argues the couple deliberately ignored the child’s worsening symptoms of illness and failed to seek medical help — a choice that led to his death.

“They never took him to receive care,” Wilmoth said. “They ignored it as his condition worsened by the day.”

Defense attorneys pointed to CPS’s inaction as a sign that authorities initially found no serious risk. But both defendants were remanded into custody pending further legal proceedings.

The case has shocked the Detroit community and raised broader questions about the failure of child protection systems to intervene. Prosecutors are expected to lean heavily on the autopsy report as the cornerstone of their case when the trial begins.
